Terms of Service — Creo Fleur Atelier

1. Acceptance

By accessing or using the Creo Fleur Atelier site or purchasing from us, you agree to be bound by these Terms of Service, our Privacy Policy, and our Return & Refund Policy. If you do not agree, do not use the Site or place an order.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. Orders placed by minors will be cancelled and refunded.

3. Products & pricing

All prices are in U.S. dollars (USD) and exclude any applicable taxes or duties. We reserve the right to correct pricing errors. Product images are representative of the print and silhouette; slight variation in print placement, dye saturation, and hem dimension is inherent to single-piece production and is not considered a defect.

4. Order acceptance & cancellation

Your order is an offer to purchase; our acceptance is confirmed by our written order-confirmation email. We reserve the right to refuse, limit, or cancel any order at our discretion (including for suspected fraud, pricing error, or capacity constraint), and to refund the original payment in full if we do so. To cancel a made-to-order piece, email returns@creofleuratelier.com within 24 hours of placing the order; after that, production has begun and the order is final.

5. Made-to-order & returns

Made-to-order pieces (the majority of our catalogue) are non-returnable, non-exchangeable, and non-refundable once production has begun. In-stock pieces may be returned within 30 days for exchange or store credit. Cash refunds are issued only for defective, damaged, or materially non-conforming pieces. 6. Intellectual property

All Site content — imagery, copy, original silk compositions, leather illustrations, the atelier visual identity — is the property of Creo Fleur Atelier or its licensors. You may save individual product images to a personal mood board and share Site links on social media with attribution. You may not bulk-scrape, reproduce, redistribute, train any AI model on, or commercially exploit any Site content without our written permission. By submitting customer content (reviews, photographs, testimonials), you grant us a worldwide, royalty-free, sublicensable licence to use it for marketing.

7. Production process

Compositions are designed at our Hoboken NJ atelier. Production is performed by professional garment workers at our London atelier: reactive-dye printing on pure silk (or the appropriate substrate for non-silk products), followed by hand cutting, sewing, and finishing. Compositions may include AI-assisted rendering tools under our curatorial direction; final compositions are original works attributable to Creo Fleur Atelier. The physical production is performed by human professional garment workers and is not AI-generated.

8. Shipping & risk of loss

Title and risk of loss pass to you upon dispatch from our atelier. Shipping rates and timelines are as published in our Shipping Policy. International customers are responsible for any customs duties and taxes assessed by their jurisdiction.

9. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.

10. Disclaimer of warranties

EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS OR REQUIRED BY APPLICABLE LAW, THE SITE, ALL CONTENT, AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We warrant against manufacturing defects for one (1) year from delivery; this is the only warranty we provide and it does not affect your statutory consumer rights where they apply by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CREO FLEUR ATELIER, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR ANY PRODUCT. Our aggregate liability for any direct damages is capped at the total amount you paid for the specific product giving rise to the claim.

12. Mandatory arbitration / class waiver

Any dispute arising out of or relating to these Terms, the Site, or any product will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Hudson County, New Jersey. You waive any right to a jury trial and to participate in any class action or class arbitration. EU and UK consumer-rights provisions apply where mandatory; nothing in this clause prevents a consumer from pursuing recourse under those mandatory protections.

13. Anti-resale & brand protection

Pieces are sold for personal use only. Bulk resale, drop-shipping, marketplace listing of new-condition pieces with the Creo Fleur Atelier name, or registration of confusingly-similar trademarks or domains is prohibited. We will enforce.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after a posted revision constitutes acceptance of the revised Terms.
